Towards this mission, it has released LERA (the “tool”), an extension compatible with Chrome Browser, to scan for accessibility errors and automates its reporting. For the terms of use of the tool, please refer to our Terms of Use https://advancedbytez.com/terms-conditions/
We wish to collect as little of your inforation as possible while you use the tool. This Privacy Policy applies when you use the tool. Please read it before using the tool because it will tell you how we collect, store, use, disclose, and otherwise process, your personal information when you use the tool. This Privacy Policy is not, however, a contract and does not create any legal rights or obligations.
Your relationship is with ABS, and the laws of Canada will govern how your information will be collected, governed, processed and used by ABS as well as our third party partners.
You are advised to carefully read this Privacy Policy and understand it well before you use the tool. If you have questions, comments, or concerns regarding our Privacy Policy or practices, please contact us.
Please note that in order to use the tool, you authorize ABS to transfer your personal information across national borders and to other countries where ABS and its partners operate. The privacy protections and rights of authorities to access your information in these countries may not be equivalent to those in your country.
Introduction
ABS is the publisher of the tool LERA, which is available as a Chrome Browser extension.
For the purposes of data protection laws, AdvancedBytez Solutions Inc. is the “data controller” of your personal information.
If you do not want ABS to collect, store, use, or share your information in the ways described in this Privacy Policy, you may not use the tool.
Information that we collect, and how we collect it
We will collect and store any information provided to us at the time of your creating an account and / or use the tool. The tool can be used without an account, in which case personal information that is to be provided for creating an account will not be collected at such juncture. The following may be read and understood in such context. This may not be understood as preventing ABS from collecting such information if provided to us in any other context.
Information about you that you share with us directly
When you register to use the tool, or use the tool without registration, or connect to us for support or other offerings, ABS collects the following information that identifies you, including:
- Full name
- Email address
- Website URLs that you audit using LERA, and the content of the website
- Password to the application associated with the account that you create (this is the password that you will use to login into the tool, and not the password of any of your e-mail or other accounts).
- Details of your account with any single sign-on service that we may eventually offer or use, including all information that is shared by such service under the terms of their service.
To help keep our databases current we may combine information provided by you with information from third party sources, in accordance with applicable law. For example, we will use a third party service for adding user to our subscription list. We may also collect and receive information from third parties, including partners, and from publicly accessible sources, for purposes that include to detect, prevent, or otherwise address fraud, security or technical issues, as well as to protect against harm to the rights, property or safety of ABS and our employees, our users, children, or the public.
Information that we collect as you use the tool
When you use the tool, we will collect information about the ways in which you use and interact with the tool, such as when, how often and for how long you use the tool and the tool’s features, websites you use or not use the tool on, frequency with which the tool is used on any particular websites or URLs and your activities on your account.
Payment Information
While ABS and the tool do not presently require or enable any payments or purchases, whenever any such feature is implemented, we will collect information related to any payments and purchases you make. However, no details of methods of payment or information related to methods of payment will be collected or stored by ABS, and the user will instead be redirected to the payment gateway.
Our third-party payment processor will collect the billing and financial information it needs to process your charges. This may include your postal address, e-mail address, and financial information. Our payment processors will not share your financial information, like credit card numbers, with us, but they may share non-financial information with us related to your purchases, like your name, billing address, and the items purchased.
Customer Support Correspondence
We will keep a record of any correspondence between us.
When you ask for help from our Customer Support team, we will collect and store the contact information you give them (generally, your name and e-mail address), information about your use or activity with the tool, and your account details. We will also store the communications you have with our Customer Support team and any additional information in those communications in order to provide support and improve the tool.
Other Sources
We may collect information from other third-party sources. Where we do, we will let you know.
We may collect or receive information about you from other sources like third-party information providers. We use this information along with information you provide us directly to improve the tool.
How we use the information we collect, and our legal bases for processing it
We use your information to provide, personalize, maintain the security of, improve and optimize the tool, to maintain business operations, to communicate with you, to protect you and others, to carry out marketing and advertising, and to exercise, defend or establish our rights.
The main use of the information we collect and store is to provide you with the tool, to improve your experience in using the tool. However, there are other uses as well, which include:
- to improve and optimize the tool, and your experience using the tool;
- to create your accounts and allow you to use the tool;
to communicate with you about the tool; - to provide technical support and respond to inquiries;
- to protect the safety and well-being of our users;
- to protect ABS’ rights and property in connection with the tool;
- to prevent fraud or potentially illegal activities, and to enforce our Terms of Service;
- to comply with our legal obligations, resolve any disputes we may have with you or other users, and to enforce our agreements with third parties; and/or
to conduct research.
If you are located in the UK or any of the countries in the European Union, our legal basis for collecting and using the information described above depends on what the information is and the context in which we collect it.
However, we will normally collect information from you only where we need it to perform our contract with you (i.e., our Terms of Service), where the processing is in our legitimate interests (provided that these aren’t overridden by your interests or rights), or if we otherwise have your consent.
In some cases, we may also have a legal obligation or need to collect information from you or may otherwise need the personal information to protect your vital interests or those of another person (for example, another user).
If we ask you to provide information to comply with a legal requirement or to perform a contract with you, this will normally be clear from the context in which we are asking you to provide your information (for example, when we ask you to provide a username to access the tool, this will be to create an account for you in accordance with our Terms of Service), and, if not, we will provide an explanation to you at the relevant time. We will also make clear whether providing information is mandatory.
Similarly, if we collect and use your information by relying on legitimate interests (or those of any third party) which are not listed above, it will be made clear to you at the relevant time what those legitimate interests are (such as personalizing the tool, for example).
If you have questions or need further information about the legal bases on which we collect and use your personal information, please contact us.
How we share information
We will share your information with third parties when you use the tool as described in this section. Please note that the term “third parties” here does not include employees and other independent contractors hired or retained by ABS to create, update, maintain and keep operational the tool.
Single sign-on services with other platforms
While presently we do not offer or use single sign-on (“SSO”) services provided by other parties, if we eventually provide or use any SSO service, we will share only such limited information (such as associated user id) as is necessary under the terms of service of such SSO service.
Safety, Security, and Compliance with Law
We will share your information if necessary for safety, security, or compliance with law.
Your information, and the contents of all of your online communications between you and ABS may be accessed and monitored as needed to provide the tool and may be disclosed:
- to satisfy any laws or regulations that apply;
- when we have a good faith belief that we have to disclose the information in response to lawful requests by public authorities, including for national security, law enforcement, or legal process purposes (for example, a court order, search warrant, or subpoena);
- when we believe in our sole discretion that the tool is being used in committing a crime, including to report such criminal activity or to share information with other companies and organizations for the purposes of fraud protection, credit risk reduction, and other security precautions;
- when we have a good faith belief that there is an emergency that poses a threat to the health and/or safety of you, another person, or the public generally; and/or
- to protect the rights or property of ABS or applicable third parties, including to enforce our Terms of Service.
Third-Party Service Providers
We will share your information with the third-party service providers and business partners that we work with to bring you the tool.
We will share your information with third-party companies who perform services on our behalf, like payment processing, analytics, analysis, hosting services, customer service, marketing, and advertising optimization. We will also share your information with our third-party business partners who assist us in delivering and optimizing our Services. Where we share your information with third-party service providers and business partners, we ensure that we have appropriate agreements in place to protect your information (as required by applicable data protection laws).
Sale or Merger
We may share your information with the interested party if we undergo or evaluate undergoing a sale or merger.
In the event that ABS undergoes or evaluates undergoing a business transition, like a merger, acquisition by another company, or sale of all or part of its assets, we may disclose or transfer all of your information, including personal information, to the successor organization in the transition. We will make reasonable efforts to let you and other users know of any such business transitions when they occur.
Other Third Parties
We may share some of your information with other third parties if we have your consent to do so.
In addition to the sharing described above, we may share your information with other third parties or allow them to collect your information from our Services in some ways not specifically described in this Privacy Policy if we have your consent to do so.
Your rights and how to access, update and manage your personal information
Under the law of some jurisdictions, you may have the right to ask us for a copy of your personal information; to correct, delete or restrict (stop any active) processing of your personal information; and to obtain the personal information you provide to us in a structured, machine readable format, and to ask us to share this information.
To exercise your rights to access or deletion, please submit a request through our Personal Data Request Portal info@advancedbytez.com.
For deletion requests, we will take reasonable measures to delete your personal information from our records. We will keep certain records (e.g., personal information relating to payments or customer service matters) where we need (and have rights) to, such as for legal or accounting purposes. We’ll also keep information in order to exercise, defend, or establish our rights.
Managing information we receive from third-parties
To manage the information that we receive from third-parties, use the tools and settings provided by the third-parties.
Once we receive your information from a third-party, that information is stored and used by us in accordance with this Privacy Policy. You may access and update that information as described above.
Opting out of promotional communication from ABS
You can unsubscribe from promotional emails by clicking the “unsubscribe” link at the bottom of any such promotional email.
Please note that if you opt out of receiving promotional communications from us, we may still communicate with you from time to time if we need to provide you with information about the tool, if we need to request information from you with respect to a transaction initiated by you, or for other legitimate non-marketing reasons, for example, if we are required under applicable laws to notify you of updates to this Privacy Policy or our Terms of Service.
California Notice
If you are a California resident, you may be able to exercise additional rights granted by California law in relation to personal information about you that we have collected, subject to certain limitations. For additional information concerning these rights, please review our California Notice https://advancedbytez.com/ccpa
Please note that we are not responsible for the ways in which third parties use your information, other than our service providers acting under our instructions.
International Operations and Transfers Out of the UK or Countries in the European Union
When you use the tool, your personal information may be sent to Canada and possibly other countries. When we process personal information collected in the UK or European Countries outside of the UK or Countries in the European Union (as applicable), we comply with our legal obligations and ensure that your personal information is subject to suitable safeguards or transferred to “approved” territories.
We store personal information about users of our tool on servers located in Canada, and we may also process this information in other countries where our business partners and service providers have their operations. Personal information collected in the UK or European Countries may be transferred to, and stored at, a destination outside of the UK or European Countries (as applicable) for purposes such as: (i) the processing of transactions and your payment details, or (ii) the provision of support services. When we transfer your personal information internationally we will take reasonable steps to ensure that your personal information is treated securely, lawfully, and in the manner we describe here. This may include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our business partners and service providers (where applicable) to protect personal information they process from the UK and the European Countries, or any other lawful solution that permits the lawful transfer of personal information from those countries. Please note that laws vary from jurisdiction to jurisdiction, so the privacy laws applicable to the places where your information is transferred to or stored, used, or processed in, may be different from the privacy laws applicable to the place where you are resident.
EU and UK residents should direct any questions, concerns or complaints regarding ABS’s handling of personal information to ABS at:
We will attempt to answer your questions and satisfy your concerns in a timely and complete manner. You may exercise any rights you have to correct, amend, or delete information about you as described in this Privacy Policy.
How Long We Keep Your Information
We will keep your information for as long as necessary to provide you with the tool, maintain our legitimate business operations, and/or exercise, defend or establish our rights.
How long we retain your personal information depends on why we collected it and how we use it, but we will not retain your personal information for longer than is necessary for our business purposes or for legal requirements.
We will retain personal information about you and connected with your account and/or your use of the tool for as long as you have an active account with us. We will take reasonable measures to delete this personal information if you delete your account. However, you acknowledge that we may retain some information after you have closed, or we have deleted, your account with us where necessary to enable us to meet our legal obligations or to exercise, defend, or establish our rights.
Security of Your Information
We implement reasonable and appropriate security measures to help protect the security of your information both online and offline and to ensure that your data is treated securely and in accordance with this Privacy Policy. These measures vary based upon the sensitivity of your information.
If you have an account registered, your profile information is protected by the password you use to access your account. It is important that you protect and maintain your account’s security and that you immediately tell us of any unauthorized use of your account. If you forget the password to your account, the tool allows you to request instructions to be sent to you that explain how to reset your password. If you access our Services through an SSO service and your SSO service provider account is compromised, this may lead to someone accessing or altering your accounts without your permission. So, you have to be careful and keep your SSO service provider account information, including your SSO service provider account password, secure as well. We urge you to log out of your account and any SSO service provider account you have used to access our tool when you are finished using the tool.
When you sign into your account or enter payment information, we and our third-party payment processor use encryption to transmit that information.
While we take precautions against possible security breaches of ABS and our customer databases and records, you must understand that no website or Internet transmission is completely secure. We cannot guarantee that unauthorized access, data loss, or other breaches will never occur, and we cannot guarantee the security of your information while it is being transmitted to us. Any transmission is at your own risk. If you have questions about the security of our websites, please contact us.
Changes to Our Privacy Policy
We reserve the right to update our Privacy Policy from time to time. When we do, we will intimate the date from which it will take effect at the top of the policy. If we make changes that we deem material, we will use reasonable efforts to notify (such as by placing a notice in the tool or on our website, or by sending you a notice to the email address we have on file for you). We encourage you to periodically check our website and this Privacy Policy for updates.
